Aisha Dahiru “Binani” Takes Legal Action Against INEC Over Nullification of Governorship Declaration

In a recent development, Aisha Dahiru, popularly known as “Binani,” the governorship candidate representing the All Progressives Congress (APC) in the March 18th gubernatorial election in Adamawa State, has filed a fresh suit against the Independent National Electoral Commission (INEC). Binani is contesting the nullification of her earlier declaration as governor of the state.

According to reports, Binani, through her legal representative, Michael Aondoaka, SAN, lodged the new suit before Justice Donatus Okorowo of the Federal High Court in Abuja. The ex-parte motion, identified as FHC/ABJ/CS/935/2023, names INEC, the Peoples Democratic Party (PDP), and its candidate, Governor Ahmadu Fintiri, as the 1st, 2nd, and 3rd respondents, respectively.

Binani seeks a judicial review of INEC’s decision to reverse her victory, which was initially announced by Hudu Yunusa-Ari, the Resident Electoral Commissioner (REC) of Adamawa State. Aondoaka argued that the responsibility to determine Binani’s fate lies with the election petition tribunal, in accordance with Section 149 of the Electoral Act, 2022.

In his submission, Aondoaka noted that INEC’s decision would deprive Binani of the provisions outlined in Section 285(6) of the Electoral Act, which grants a 180-day period for the resolution of her petition filed before the tribunal on May 6. He informed the court that a similar suit had previously been filed before Justice Inyang Ekwo, who directed Binani to approach the election petition tribunal due to the matter’s election-related nature.

Aondoaka, therefore, requested a review of INEC’s action, emphasizing that an undertaking had been presented to prove the seriousness of the case. The legal team expressed their readiness to face any costs should the court find their case to be frivolous.

After listening to Aondoaka’s arguments, Justice Okorowo temporarily adjourned the matter to deliver a ruling.
